Terms of service.

When using the services of Archimedia, you agree to be legally bound by the terms set out below.

 

Definitions

 

‘Client’ means anyone who has placed a booking with Archimedia

‘Archimedia’ means anyone working on behalf of Archimedia.

‘Property’ means the Property placed with Archimedia for Capture.

‘Capture(s)’ means any service (floorplans, photography, videography, etc provided by Archimedia for the Client.

 

  1. Booking Services

Bookings are based on a “first come, first served” basis. It is the Client’s responsibility to choose the right Captures for their needs. Archimedia shall not be responsible if the Client is unsatisfied with the results, if the wrong Capture has been chosen, whether the Client can use it or not. If the Client makes a booking with wrong or missing information, then the Client will be responsible for any delays/cancelations/errors or missing material that may occur. A booking becomes a firm appointment only when the Client receives a confirmation email, not via the phone or by verbal agreement.

Bookings can be arranged during a weekend. However, there will be an additional 20% fee attached to any bookings scheduled over a weekend.

2.     Access

 It is the Client’s responsibility to arrange access to the Property and to ensure the Property is suitably presented although, with prior agreement, from time-to-time Archimedia are happy to assist with presentation & access. Archimedia shall not be responsible for Captures not taken as a result of the Client’s failure to provide reasonable assistance or cooperation. It is the Client’s responsibility to send Archimedia clear instructions. If revisits are necessary because of incomplete, inaccurate instructions this will be at the Client’s expense.

3. Cancellations

When the Client receives their confirmation email their booking is confirmed and the cancellation policy becomes active. Any booking cancelled 24 hours before the confirmed booking time & date will incur no charge. Any booking cancelled after the within 24 hours of the booking time & date will be charged at 50% of the total cost of the confirmed Capture. If Archimedia cannot start a Capture for more than 30 minutes, due to the lack of access to the Property or other circumstances beyond Archimedia’s control, the Client will be charged the booking fee of 50% of the total cost of the confirmed Capture and the booking will be cancelled.

4. Security

Properties will be left as found and should any doors or windows not be safely secured Archimedia will make reasonable attempts to advise the Client and seek their instructions. Any keys collected will be returned as quickly as possible but cannot be guaranteed to be immediately after the appointment. The Client agrees to always act in good faith towards Archimedia and will endeavour to provide reasonable instructions for the return of keys. Any key collection which requires Archimedia to travel a distance exceeding a 5 miles radius from the Property, will be charged an extra £19. If it exceeds a 10 miles radius then an additional £39 will be charged.

5. Floorplans

All floorplans supplied by Archimedia are for layout guidance only. Windows and door openings are approximations, they are not drawn to scale, unless stated otherwise. It is the Client’s responsibility to ensure that the supplied plan correctly represents the Property. Whilst we aim to provide plans that are accurate and correctly represent the rooms within a property, Archimedia shall not be held liable for any incorrect measurements and/or calculations. All measurements and areas quoted are approximations, whether a suitable disclaimer appears on the plan or not and Archimedia cannot be held responsible for any error, omission or misstatement on the floorplan. Archimedia accepts no liability if the valuation of the property is based on the measurements of the plan drawn by Archimedia.

6. Copyright

Archimedia shall exclusively own all copyright and other intellectual property rights relating to all material and resources. Archimedia can use all Capture material produced for the Client in any manner at any time and in any part of the world for the purposes of advertising. The license does not allow the distribution of the images by the Client to the Property owner or connected persons. The use of Archimedia material without the express permission of Archimedia or without payment, will result in a breach of copyright.

7. Payment

First-time Clients will be invoiced upon completion of the project. All subsequent bookings will be invoiced on the first working day of the month and payment is due within 7 days. If payment is not received within this time, Archimedia will cancel any subsequent jobs and will cancel all confirmed bookings with the Client. However, the materials from these bookings will be withheld until the outstanding invoices have been paid. All invoices will be made out to the Client who is responsible for making payment. Archimedia will not invoice any third party. All payments must be made by bank transfer to the specified account on the invoice. All payments must include the invoice number as a reference so your payment can be identified.

8. Law

In the event that the Client gives Archimedia instructions which are followed in good faith, and which turn out to be unlawful, result in an unlawful act or otherwise give rise to any other claim, the Client will provide Archimedia with full indemnity for all penalties, damages, costs and legal expenses whatsoever which may occur as the result of following the instructions. If any part of these terms and conditions is found to be void or unenforceable the rest of the terms and conditions will still remain in full force. Any dispute arising these terms and conditions will be governed by the laws of the United Kingdom.
